Supreme Court Order: Do not implement the decision to withhold NOC from students going to study in South Korea

Suprime Court of NepalKathmandu |The Supreme Court has issued an interim order not to immediately implement the government’s decision to suspend study permits for South Korea.

A single bench of Justice Sunil Pokharel on Tuesday (Jest 13) issued an interim order not to immediately implement the government’s decision to suspend the foreign study permit (NOC) required to study in South Korea.

The order states, “The decision of the opposing ministry dated 2082/1/28 BS (2025/May/11 AD) stating that the work of granting permission to students going to study in South Korea has been suspended regardless of the fact that the academic session has already begun, and the notification dated 2082/1/30 BS (2025/May/13 AD) published on the basis of that decision, should not be implemented.”

The order asks that the decision to suspend the permission of students who have completed the entire process and received scholarships, will cause irreparable damage to them, and that the notification should not be implemented until the final decision of the writ petition is made.

The order was made after conducting a preliminary hearing on the writ petition filed by the victim student Eliza Pandey and others against the government’s decision, making the Ministry of Education, Science and Technology the defendant. The order asks that a written response with reasons be submitted within 15 days.
